At The Herron Law, we frequently receive phone calls from people who had bad experiences with their lawyer. In some cases, it is not a good idea to fire your lawyer. We believe that the majority of personal injury attorneys are doing the right things for your car accident case, but they are not good at communicating their mission to you. There are indeed many personal injury attorneys that deserve that bad reputation.
Do your research before you hire anyone. Here is the example: In one case we heard about, a person had a long term disability case hired one of those law firms you see a lot on TV. The person had a court date on the calendar for months. They went to court, but their attorney did not. The court date was reset, and when they called the attorney’s office, he told them he was not working there anymore. The client was supposed to receive “the letter” that he never got, explaining his choices. That person’s case was shuffled from one attorney to another. This left the disability case client unsure what the status of their case was and if it was being handled correctly.
The problem with some ‘big box’ law firms is they just “mill” through cases. They often do not give much thought to the people they are representing. Many attorneys who work for these big law firms come and go quickly. They often leave very unhappy with how clients are treated. That is not true for every big law firm, of course, but at The Herron Law, we do hear about that often.
If you are hurt in a car accident in Portland, you obviously want the best personal injury attorney. We recommend taking at least following 3 steps:
1. Do your research.
We are very surprised that people hire an attorney with a lot of bad online reviews. A quick search online should tell you about the attorney and how he treats his clients. Tip: Do not search by the name of the law firm. Search by the name of the attorney. Once you have a few names, call each one and ask them questions about your case. If they cannot answer quickly, you may want to move on to another attorney.
2. Call and interview. One thing you should inquire about is their legal fee structure, including their contingency fee, who pays for ongoing legal expenses (some attorneys cover these costs and take them out of your settlement, while others make you pay them upfront).
3. Before hiring, understand who your point of contact is at the law firm. Many lawyers fall down when it comes to communicating with the client. Ideally, you will be able to speak to your attorney regularly for lawsuit updates. But it is fine if you have a legal assistant or paralegal assigned to your case as the point of contact, as long as they are readily available and can answer your questions. Do you know that some lawyers don't have a legal assistant or even a secretary to help with appointment scheduling and other administrative office jobs? Imagine if your surgent didn't have a receptionist to take patients phone calls or arrange surgery schedules and had to do it all by himself while performing procedures on you?
