What Is The Average Settlement For Pain and Suffering?

After a serious car accident such as the above, the injured will probably ask what their pain and suffering is worth. Every car accident settlement must take several things into account:

  • Type of medical treatment received by the victims
  • Length of recovery time
  • Long term effects of the injuries
  • How long a hospital stay there was and were surgeries required

That said, on average, many personal injury attorneys say the most common settlement for pain and suffering for most car accident claims is less than $15,000. That is simply because most car accidents involve minor injuries.

But the severity of the injury is a massive factor that affects your pain and suffering damages in an Oregon car accident.

It is possible for a plaintiff to receive hundreds of thousands of dollars in pain and suffering. But a case like that will usually require a serious injury, surgery, a lengthy hospital stay, followed by extensive rehabilitation.

A skilled personal injury attorney in Portland will primarily rely on your medical records and bills to prove the degree of pain and suffering you have gone through. Also, cases where the injuries are graphic and obvious, photos can go a long way to increasing your pain and suffering settlement. Even better, videos showing your surgery are helpful to show the pain you are going through.

If the case gets to the lawsuit phase, the plaintiff’s testimony under other is a significant factor in the size of the pain and suffering award. The defense attorney will carefully go over your medical records and will probe to see if you are exaggerating your pain and suffering.

Also, a good personal injury attorney may have an idea of what a particular insurance adjuster will offer for a particular type of injury. Most attorneys keep track of their settlements with adjusters and insurance companies. There are case management programs out there that help attorneys do this. It is very important to track how past negotiations went with a particular adjuster. That can help a lot then next time the attorney has to negotiate a pain and suffering settlement.
